1. Acceptance of Terms

By accessing our website at onlinetourpackage.in or booking any tour package through Kerala Tour (operated by OnlineTourPackage), you agree to be bound by these Terms and Conditions. If you do not agree to any part of these terms, please do not use our services.

These Terms constitute a legally binding agreement between you ("Traveler") and OnlineTourPackage ("Company", "we", "us"). These Terms apply to all tour bookings, inquiries, and services offered by us.

2. Bookings & Payments

2.1 Booking Confirmation

A booking is confirmed only upon receipt of the advance deposit as specified at the time of booking and issuance of a written confirmation from our side. Verbal commitments do not constitute a confirmed booking.

2.2 Advance Payment

• A minimum advance of 25%–50% of the total package cost is required to confirm your booking.
• The balance payment must be cleared at least 7 days before departure, unless otherwise agreed in writing.
• Payments can be made via bank transfer (NEFT/RTGS/IMPS), UPI, credit/debit card, or other modes specified at checkout.

2.3 GST & Taxes

All prices are inclusive of applicable GST as per the Government of India's tax regulations. GST invoices will be provided upon request with your GSTIN details.

3. Pricing & Inclusions

3.1 What's Included

Each tour package clearly states what is included. Standard inclusions are accommodation (as specified), meals (as mentioned), transportation, and sightseeing as per the itinerary.

3.2 What's Not Included

• Airfare / train tickets unless specifically mentioned
• Personal expenses such as tips, laundry, phone calls, and shopping
• Travel insurance (strongly recommended)
• Entry fees to monuments, national parks, or attractions unless specified
• Any meals not mentioned in the itinerary
• Costs due to flight delays, cancellations, or natural calamities

3.3 Price Validity

Quoted prices are valid for the dates specified at the time of booking. Prices are subject to change due to fuel surcharges, government levies, seasonal fluctuations, or currency changes.

4. Traveler Responsibilities

• Travelers must carry valid government-issued photo ID (Aadhaar, Passport, Driving Licence, Voter ID) throughout the trip.
• Foreign nationals must carry their passport and valid India visa at all times.
• Travelers are responsible for ensuring they meet all health and fitness requirements for the chosen activities (trekking, adventure sports, etc.).
• Any medical conditions must be disclosed at the time of booking. We reserve the right to deny participation to those who pose a risk to themselves or others.
• Travelers are responsible for their personal belongings. The Company is not liable for loss or theft.
• Respectful conduct towards fellow travelers, guides, locals, and the environment is mandatory.

5. Itinerary Changes

While we strive to follow the published itinerary, we reserve the right to modify it due to:

• Weather conditions or natural disasters
• Road closures or government advisories
• Operational requirements beyond our control
• Safety concerns for travelers

In such cases, we will provide a suitable alternative of equal or greater value wherever possible. No refunds will be issued for changes made due to unforeseen circumstances beyond our control.

6. Limitation of Liability

OnlineTourPackage acts as an organizer and facilitator. We are not liable for:

• Personal injury, illness, or death arising from participation in activities
• Loss of baggage or personal belongings
• Delays caused by airlines, railways, or road transport
• Acts or omissions of third-party service providers (hotels, airlines, activity operators)
• Any indirect, consequential, or punitive damages

Our maximum liability shall be limited to the amount paid by the traveler for the tour package.

7. Force Majeure

The Company shall not be liable for any failure to perform its obligations due to events beyond its reasonable control, including but not limited to acts of God, floods, earthquakes, epidemics, pandemics, war, riots, government-imposed restrictions, strikes, or any other event of force majeure.

In such events, we will make reasonable efforts to provide alternatives. If a tour is cancelled due to force majeure, our Refund Policy shall apply.

8. Disputes & Governing Law

Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved amicably through mutual discussion. If unresolved, disputes shall be subject to the exclusive jurisdiction of courts in Uttarakhand, India.

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of India.
